Space Elevator — Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the Space Elevator mobile application, website, and backend services (collectively, “the Service”), operated by Digital Paradise Systems LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@spaceelevator.app if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

You may not create an account on behalf of another person without their authorization, or create multiple accounts to circumvent a suspension or restriction.

4. Subscriptions, Free Trial, and Billing

The Service offers the following paid subscription plans:

Free trial: Each plan includes a 7-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the applicable rate.

Billing: All billing for App Store purchases is handled by Apple and is subject to Apple’s payment terms. We do not directly process or store your payment information.

Cancellation: You may cancel at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by applicable law.

Storage limits: If your uploaded content exceeds your plan’s storage limit, upload functionality will be suspended until you upgrade your plan or free up space by deleting content. Existing content will not be deleted due to exceeding your storage limit.

Price changes: We may change subscription pricing at any time with reasonable advance notice. Continued use of a paid plan after a price change takes effect constitutes acceptance of the new price.

5. Your Content

You retain ownership of all photos, videos, and other content you upload to the Service (“Your Content”). By uploading content, you grant Digital Paradise Systems LLC a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely as necessary to provide the Service to you. We do not claim ownership of Your Content and we do not use it for any other purpose.

You are solely responsible for Your Content and represent that you own or have the necessary rights to upload it, and that it does not violate any applicable law or third-party rights.

6. Acceptable Use

You agree not to upload, share, or transmit content that:

• Violates any applicable local, state, national, or international law
• Is sexually explicit or pornographic in nature
• Depicts or facilitates child sexual abuse or exploitation (we are required by law to report such content to the National Center for Missing and Exploited Children and relevant law enforcement)
• Constitutes harassment, threats, or abuse directed at any individual or group
• Infringes the intellectual property, privacy, or other rights of any third party

You also agree not to:

• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use the Service to distribute malware or conduct phishing attacks
• Scrape, crawl, or systematically extract data from the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts responsible for such violations.

7. Account Termination

By you: You may delete your account at any time through the App. Upon deletion, your account data and uploaded content will be removed from our servers within 30 days, as described in our Privacy Policy.

By us: We may suspend or terminate your account if we determine you have violated these Terms, with or without prior notice depending on the severity of the violation. If we terminate your account without cause, we will provide a prorated refund of any prepaid subscription fees.

8. Service Availability

We will make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend the Service for maintenance, upgrades, or circumstances beyond our control. We are not liable for losses resulting from Service downtime or unavailability.

9. Intellectual Property

All software, design, trademarks, and other materials comprising the Service (excluding Your Content) are the property of Digital Paradise Systems LLC or its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL PARADISE SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Digital Paradise Systems LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Alabama, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration against Digital Paradise Systems LLC.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access to the Service.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
